The icon that you are using is my personal avatar; I created it for my own personal use, on my own blog, and clearly marked it as such on my blog (http://www.livejournal.com/allpics.bml?user=crumpetsfortea)

I would, therefore, request that you remove this avatar from your blog and use another, as I retain the copyright to that work and have not released it for use under a creative commons or other license, and your use of the icon does not fall under a fair use policy.

Hello Andrea,

I asked you under my LJ account (olde_fashioned) if my brother might be allowed to use this exact icon on a non-LiveJournal site, and you gave your full permission. So he already has your permission to use this, unless you decide to change your mind and take it back.

Thank you for clarifying that; I didn't realize that it was you to whom I gave my permission. However, I am an evolutionary biologist and paleontologist by trade, and therefore, would like to ask you to remove the icon, because, quite frankly, I don't want myself or my work, especially something so closely associated with my livejournal blog, also associated with a creationist site; it honestly makes both of us look bad.

If you would please replace the icon, I would appreciate this very much.

I confess I am rather at a loss to understand why a Creationist using one of your icons would be a disgrace to either -- ?? I would have thought a mutual agreement to "live and let live" and get along in spite of differences would be rather a compliment to both.

If you insist on demanding that he remove it, I'm sure my brother will comply with your wishes, however I wish that you might be willing to honour your previous agreement with myself, since you did not stipulate any conditions in regards to the user's personal beliefs and convictions. (and, I might humbly add, that my brother's blog is linked from my own, and you might have looked and leanred about his views as well mine by clicking on my LJ profile before you said yes.)

Either way, no hard feelings from me.

Because my livejournal is linked from my professional site and anyone who goes to that journal sees that icon marked as "mine" and "personal," I am afraid that someone, upon seeing both sites could misconstrue his use of the icon as a personal endorsement of a creationist viewpoint, which could be severely detrimental to my career and credibility as a researcher.

I granted permission without checking to look at either your personal views or your brother's, a rather naive mistake. I now regret granting that permission, and acknowledge that the mistake is mine. I realize that it is a small inconvenience to your brother to change the icon, but I wish to reiterate my request that the icon be removed.

It isn't any trouble at all. The icon has now been removed. I'm sorry about the trouble. I hope this can "end" on a friendly footing?

P.S. For what it's worth, I would like to reiterate that anyone is welcome on my blog, including those I may disagree with. And especially paleontologists.
